إن ما جرى في طولكرم، وما يجري في غزة والضفة الغربية والقدس، لم يعد مجرد أحداث عابرة، بل سياسة ممنهجة لانتهاك حقوق الإنسان في أبسط صورها، وخرق صارخ للقانون الدولي الإنساني ومواثيق حقوق الإنسان العالمية. سوق المدنيين الفلسطينيين من الأسواق والمنازل والشوارع، وإذلالهم بصورة علنية أمام عدسات الكاميرات، يشكل جريمة حرب وفق المادة 147 من اتفاقيات جنيف الرابعة، ويدخل ضمن الجرائم ضد الإنسانية وفق المادة 7 من نظام روما الأساسي. كما أن سياسات التجويع والحصار والحرمان الممنهج تمثل جريمة إبادة بموجب المادة 6 من نظام روما الأساسي.
وانطلاقًا من المسؤولية القانونية والأخلاقية، فإن الرسالة توجه نداءً مباشرًا إلى:
منظمة بتسليم الإسرائيلية وكافة المنظمات الحقوقية الإسرائيلية المستقلة المعنية بحقوق الإنسان، بضرورة توثيق الجرائم التي ارتُكبت في طولكرم بشكل عاجل، وفتح تحقيق أمام الجهات المختصة داخل إسرائيل، وملاحقة المسؤولين عن هذه الانتهاكات الجسيمة التي شكلت إهانة لكرامة الإنسان الفلسطيني، بما يعزز المساءلة ويفضح السياسات الممنهجة للاحتلال أمام المجتمع الدولي.
كما تطالب الرسالة امين عام الامم المتحدة والمجتمع الدولي ومجلس الأمن بما يلي:
1. التدخل الفوري لتأمين الحماية الدولية للمدنيين الفلسطينيين.
2. محاسبة قادة الاحتلال أمام المحكمة الجنائية الدولية دون تعطيل أو تأخير.
3. فرض عقوبات ملزمة ورادعة على إسرائيل لضمان احترامها للقانون الدولي.
4. تحميل الدول الداعمة للاحتلال سياسيًا وعسكريًا وماليًا المسؤولية القانونية الدولية عن تمكينها من ارتكاب جرائمها، وذلك بموجب مشروع لجنة القانون الدولي حول مسؤولية الدول عن الأفعال غير المشروعة دوليًا (2001).
5. تفعيل قرارات الأمم المتحدة، وخاصة القرارين 242 و338، كأساس لإنهاء الاحتلال وتمكين الشعب الفلسطيني من إقامة دولته المستقلة وعاصمتها القدس.
إن ما حدث في طولكرم وما يتكرر يوميًا في غزة والضفة الغربية والقدس يمثل أزمة أخلاقية وقانونية عالمية، تستوجب تحركًا عاجلًا وحاسمًا. فالصمت الدولي والتراخي في ملاحقة هذه الجرائم لن يُفهم إلا كتواطؤ، وسيؤدي إلى انفجار يهدد الأمن والاستقرار الإقليمي والدولي ويقوض أي فرصة لتحقيق سلام عادل ودائم.

Open Letter to the UN Secretary-General, International Human Rights Organizations, and B’Tselem

The events in Tulkarm, and the ongoing violations in Gaza, the West Bank, and Jerusalem, are not isolated incidents but a systematic policy of violating the most basic human rights and blatantly breaching International Humanitarian Law and international conventions. Forcing Palestinian civilians from markets, homes, and streets, humiliating them publicly in front of cameras, constitutes war crimes under Article 147 of the Fourth Geneva Convention, and falls within crimes against humanity under Article 7 of the Rome Statute. Policies of starvation, blockade, and systematic deprivation amount to genocide under Article 6 of the Rome Statute.
In light of legal and ethical obligations, this letter specifically addresses:
B’Tselem and all independent Israeli human rights organizations, urging them to urgently document the crimes committed in Tulkarm, open investigations before the competent Israeli authorities, and pursue accountability for those responsible for the gross violations that degraded human dignity. Such actions are critical to ensuring accountability and exposing the systematic policies of the occupation before the international community.
The letter further calls upon the international community to:
1. Immediately secure international protection for Palestinian civilians.
2. Hold Israeli leaders accountable before the International Criminal Court without obstruction.
3. Impose binding and deterrent sanctions on Israel to ensure compliance with international law.
4. Hold states that support Israel politically, militarily, and financially legally responsible for enabling its crimes, in line with the International Law Commission’s Articles on the Responsibility of States for Internationally Wrongful Acts (2001).
5. Activate UN resolutions, particularly 242 and 338, as the foundation for ending the occupation and enabling the Palestinian people to establish their independent state with Jerusalem as its capital.
What happened in Tulkarm, and what continues daily in Gaza, the West Bank, and Jerusalem, constitutes a global moral and legal crisis that demands urgent and decisive action. Continued silence and failure to pursue accountability will only be understood as complicity, leading to an explosion that threatens regional and international peace and undermines the prospects of a just and lasting peace.
